Using Your SMSF to Buy Commercial Property

What Is an SMSF Commercial Loan?

A Self-Managed Super Fund commercial loan allows your SMSF to borrow money to purchase commercial property through a structure known as a Limited Recourse Borrowing Arrangement, or LRBA. Under this arrangement, the property is held in a bare trust on behalf of your fund until the loan is fully repaid. Bill Bell Finance works with clients across Gawler, wider Adelaide, and Australia-wide to connect them with lenders who offer SMSF commercial loan products suited to their fund's circumstances.

It is important to understand that an SMSF commercial loan is a specialist area of finance. The rules governing these arrangements are set out in the Superannuation Industry (Supervision) Act 1993, commonly known as the SIS Act, and are administered by the Australian Taxation Office. As at 10 August 2026, the ATO confirmed that the new LRBA rules introduced by the Treasury Laws Amendment (Tax Reform No. 1) Act 2026 commenced on that date. Importantly, LRBAs for commercial property that qualifies as business real property under section 66 of the SIS Act are not affected by those changes. Bill Bell Finance strongly recommends that all clients seek advice from a licensed SMSF specialist before acting on any information about SMSF loans.

What Counts as Business Real Property?

Not every property marketed as commercial will qualify as business real property under the SIS Act. The definition generally covers land and buildings used wholly and exclusively in one or more businesses. Whether a property meets this test depends on its actual use at the time of acquisition, not simply how it is described or advertised. Detailed guidance is set out in SMSFR 2009/1 published by the ATO.

Mixed-use properties require careful assessment. A property with a residential component may not qualify, or may only partially qualify, depending on the specific circumstances. A limited concession exists for certain primary production properties, but this is not a general exemption for all mixed-use properties. If you are considering using super to buy commercial property, it is essential to confirm whether the property satisfies the business real property definition before proceeding.

Can I Buy Business Premises With My SMSF?

One of the most common questions Bill Bell Finance receives is whether a business owner can buy business premises with their SMSF and then lease that property back to their own business. The answer is that this is permitted under the SIS Act, provided the property qualifies as business real property and the SMSF related party lease is made on arm's length terms at market value. Business real property leased between the fund and a related party is excluded from the in-house asset rules, which is a significant advantage for small business owners.

This type of arrangement, sometimes called SMSF owner-occupied commercial property, can allow a business to pay rent directly into the super fund rather than to a third-party landlord. The SMSF commercial rental income received by the fund is generally taxed at the concessional superannuation rate of 15 per cent in the accumulation phase, and the fund may also be eligible for the SMSF CGT discount on any capital gain made when the property is eventually sold, subject to the fund meeting the relevant conditions.

SMSF Commercial Loan Rates and Structure

When you compare SMSF commercial lenders, you will find that loan terms vary considerably between providers. SMSF commercial loan rates depend on factors including the loan-to-value ratio, the nature of the property, and the overall financial position of the fund. Most lenders offer both SMSF fixed rate commercial and SMSF variable rate commercial options, and the SMSF commercial loan LVR is typically lower than what is available for standard investment loans, often ranging from 60 to 70 per cent.

As your SMSF commercial property broker, Bill Bell Finance compares SMSF commercial lenders across its panel to identify options that align with your fund's needs. Our role is to handle the loan sourcing and application process, while your SMSF specialist accountant and legal adviser handle the fund compliance and bare trust documentation. Important Restrictions to Be Aware Of

There are several restrictions that apply to all LRBAs. Borrowed funds cannot be used to improve an existing asset, only to acquire it. An existing fund asset cannot be placed into an LRBA. Capital improvement drawdowns are not permitted for arrangements entered into on or after 7 July 2010. Additionally, multiple real property titles cannot generally be acquired under a single LRBA unless the properties are identifiable as a single asset, meaning they are bought and sold together and have equal market value.

All SMSF investments, including commercial property held under a limited recourse borrowing arrangement commercial structure, must be maintained for the sole purpose of providing retirement benefits for fund members. Any decision that provides a present-day benefit to members or related parties may contravene section 62 of the SIS Act. A thorough SMSF commercial loan application process will involve your legal and accounting advisers confirming that all of these requirements are satisfied before settlement.

Bill Bell Finance is here to help clients across Gawler, Adelaide, and Australia-wide understand their SMSF loan options and connect with lenders who can support their goals. Speak with our team today to find out more about how we can assist with your investment loans and SMSF lending needs.

Our Lending Process

Our Simple Process

Step 1: Let's Have a Chat

Every good partnership starts with a conversation. When you sit down with your local Gawler mortgage broker at Bill Bell Finance, we're not jumping straight into numbers and paperwork. We want to hear about you, your goals, and what this loan means for your life. Whether you're buying your first home, refinancing your home loan, looking at investment loan strategies, using equity to renovate, building with a construction home loan, consolidating debt into your mortgage, exploring SMSF property loans, or growing your business with commercial finance, we'll walk you through how it all works in plain English. We have access to hundreds of lenders across Australia, so we'll explain the different loan structures, interest rates, offset account strategies, and repayment options that could suit your situation. No jargon, no pressure, just an honest conversation about where you're at and where you want to be.

Step 2: Getting the Full Picture

Once we know what you're working towards, we'll gather the details that help us find the right fit. Using a simple online fact-finding tool, we'll collect information about your income, expenses, assets, and any existing debts to work out your borrowing capacity. We'll also review documents like bank statements and tax returns to get a clear understanding of your financial position. If you're applying for a business loan, we'll look at cash flow, loan requirements, and the paperwork typically needed for your application. This step is all about accuracy and making sure nothing gets missed, so the recommendations we bring back to you are grounded in your real situation, not guesswork.

Step 3: Finding the Right Loan for You

With your full picture in front of us, we get to work comparing options across our wide panel of lenders. We look at more than just the interest rate. We consider loan features like offset accounts versus redraw facilities, whether you can make extra repayments without penalties, fixed versus variable rate pros and cons, and how each option fits with your goals. Whether that's paying off debt sooner through debt consolidation, keeping repayments manageable, structuring an investment loan for your property portfolio, refinancing for renovations using your home equity, or setting up a construction loan with the right drawdown structure, we then come back to you with a clear recommendation and talk you through why we think it's the right move.

Step 4: Securing Your Pre-Approval

For property purchases, getting loan pre-approval is a big milestone. It means you can start making offers or bidding at auction with confidence, knowing your finance is lined up. We'll explain your borrowing capacity, repayment structure, and the differences between fixed and variable interest rates. We'll also cover things like your loan-to-value ratio, whether lenders mortgage insurance applies, stamp duty considerations, and any costs you should plan for. For first home buyers, we'll walk you through available grants and concessions. If you're refinancing to access equity, restructuring business finance, or setting up an SMSF loan, we'll guide you through the equivalent approval steps so you know exactly where you stand.

Step 5: Lodging Your Application

Once you're happy with the plan, we handle the heavy lifting. We prepare and submit your application, chase up anything the lender needs, and keep you updated every step of the way. People often ask how long refinancing or the loan application process takes, and we'll give you a realistic timeline upfront so there are no surprises. You won't be left wondering what's happening or when to expect the next update. We stay on top of it so you don't have to.

Step 6: Settlement and Beyond

When everything is approved and your loan settles, that's not the end of our relationship. It's just the start. We'll make sure the loan settlement process is smooth, whether that means coordinating with solicitors, managing progress payments on a construction loan, or simply making sure your repayments are set up correctly. After settlement, we keep an eye on your loan and the market to make sure your finance continues to work hard for you, including helping you make the most of your offset account and exploring whether your home loan interest could offer any tax benefits worth discussing with your accountant.

Step 7: A Partner for the Long Run

Life changes, and your finances should keep up. As your local Gawler-based mortgage brokers serving Angle Vale, Virginia, the Barossa Region, Munno Para West, and surrounding areas, we're here for the long haul. Whether you want a loan health check, need to refinance your home loan for renovations, consolidate credit card debt into your mortgage, explore using equity to renovate, plan your next investment property, or simply check in on how your offset or redraw is working for you, we're just a phone call away. We're part of this community, and helping our clients build a stronger financial future is what gets us out of bed in the morning.

Frequently Asked Questions

Got Questions?

Why should I choose Bill Bell Finance over a larger national broker?

At Bill Bell Finance, you are not just a number in a system. We are a locally based business with genuine ties to the Gawler community and the wider Adelaide region, and we care about the people we work with. When you work with us, you deal with real people who take the time to understand your individual situation rather than fitting you into a standard process. We are accessible, approachable, and committed to being honest with you throughout. Larger operations can sometimes feel impersonal, and it can be hard to know who you are dealing with from one week to the next. With Bill Bell Finance, you know exactly who you are talking to, and we are always here when you need us.

How long does the home loan process take?

The timeline for a home loan can vary depending on a number of factors, including the lender, the complexity of your application, and how quickly documents can be gathered and verified. In general, the process from initial application to formal approval can take anywhere from a few days to several weeks. At Bill Bell Finance, we work to keep things moving as efficiently as possible and will keep you updated along the way so you are never left wondering what is happening. We know that waiting for news on something this important can be stressful, and we take our responsibility to communicate with you seriously. We will always be upfront with you about expected timeframes.

What is refinancing and should I consider it?

Refinancing means replacing your existing home loan with a new one, either with your current lender or a different one. People refinance for all sorts of reasons. Some want to access equity in their property, others want to consolidate debts, and some simply want to review whether their current loan still suits their needs. Whether refinancing makes sense for your situation depends on a range of personal and financial factors, and it is not the right move for everyone. At Bill Bell Finance, we do not push refinancing for the sake of it. We will have an honest conversation with you about your current situation and help you understand what your options are, so you can make an informed decision that is right for you.

Can Bill Bell Finance help if I am a first home buyer?

Absolutely. Buying your first home is one of the biggest financial decisions you will ever make, and it can feel overwhelming when you are not sure where to start. At Bill Bell Finance, we work with first home buyers regularly and understand the questions and concerns that come with it. We will take the time to explain how the process works, what lenders typically look for, and what options might be available to you based on your circumstances. We can also talk you through government schemes and grants that may be relevant to first home buyers in South Australia, so you have a clearer picture of what support might be out there. You do not need to have all the answers before you call us.

What do I need to bring to my first appointment with Bill Bell Finance?

Your first appointment with Bill Bell Finance is really just a conversation. We want to get to know your situation and understand what you are hoping to achieve. That said, it can be helpful to have a general idea of your income, your regular expenses, any existing debts, and what you are looking to borrow for. If you have recent payslips, bank statements, or identification documents handy, that is a bonus, but do not stress if you do not have everything together yet. We will guide you through what we need as we go. The first step is simply having a chat, and we will take it from there at a pace that suits you.

How is Bill Bell Finance different from going directly to a bank?

When you go directly to a bank, you are only seeing what that one lender can offer you. At Bill Bell Finance, we have access to a panel of lenders, which means we can look across multiple options to find something that may suit your situation. We are not tied to any single lender, so our focus is on finding what works for you rather than pushing a particular product. On top of that, we handle the paperwork, follow up with lenders, and keep you informed throughout the process. For many people, having someone in their corner who knows the process well makes a real difference, especially when it comes to something as significant as a home loan.

How much does it cost to use Bill Bell Finance?

In most cases, our service comes at no direct cost to you as the borrower. Mortgage brokers are typically paid a commission by the lender when a loan settles. This means you can access our knowledge and support without paying out of pocket for it. We are always upfront about how we are paid and will explain this to you clearly before we proceed. If there are any situations where a fee might apply, we will let you know well in advance so there are no surprises. Transparency is important to us, and we want you to feel completely comfortable with how the process works before we get started.

What types of loans can Bill Bell Finance help with?

Bill Bell Finance can help with a range of lending needs. This includes home loans for first home buyers, people looking to refinance an existing loan, those purchasing an investment property, and people building or renovating. We also assist with car loans, personal loans, and commercial finance depending on your circumstances. Every situation is different, and we do not take a one-size-fits-all approach. We take the time to understand what you are trying to do and then look at what options might suit your needs. If we think something is not right for you, we will tell you that too. Honesty is something we take seriously at Bill Bell Finance.

Is Bill Bell Finance only for people in Gawler?

Not at all. While Bill Bell Finance is proudly based in Gawler and has strong roots in the local community, we work with clients across greater Adelaide and right across Australia. Whether you are just down the road or in a different state entirely, we are set up to help you. We can meet in person if you are local, or we can connect over the phone or via video call if that suits you better. Distance is not a barrier when it comes to getting the right support for your home loan or finance needs. We are here for anyone who wants a straightforward, honest conversation about their options.

What does a mortgage broker actually do?

A mortgage broker acts as the go-between for you and a range of lenders. Rather than you having to approach each bank or lender on your own, a mortgage broker does the legwork of researching your options, preparing your application, and communicating with lenders on your behalf. At Bill Bell Finance, we take the time to understand your situation before we do anything else. We listen to what you are trying to achieve, look at what is available across our panel of lenders, and then walk you through your options in plain language. Our goal is to make sure you feel informed and supported at every step of the process.
